Spencer Elden is suing the band for child sexual exploitation, saying he was unable to consent to having his image used for the iconic 1991 album.

Nirvana’s surviving members and the estate of Kurt Cobain have been sued by Spencer Elden, who appeared as a baby on the cover of 1991’s Nevermind. Elden claims the band violated federal child pornography statutes and argues child sexual exploitation, TMZ reports and documents viewed by Pitchfork confirm. Pitchfork has reached out to Nirvana’s representatives for comment.

In a lawsuit that also named photographer Kirk Weddle and the labels behind the album’s release, Elden claims he has suffered “lifelong damages” and says his legal guardians never signed a release “authorizing the use of any images of Spencer or of his likeness, and certainly not of commercial child pornography depicting him.” He’s also suing for distribution of private sexually explicit materials, negligence, and what’s described as a “sex trafficking venture” where Elden “was forced to engage in commercial sexual acts while under the age of 18 years old.”

Elden is seeking damages, attorney fees, an injunction to prohibit all parties “from continuing to engage in the unlawful acts and practices described herein,” and a trial by jury.

“The permanent harm he has proximately suffered includes but is not limited to extreme and permanent emotional distress with physical manifestations, interference with his normal development and educational progress, lifelong loss of income earning capacity, loss of past and future wages, past and future expenses for medical and psychological treatment, loss of enjoyment of life, and other losses to be described and proven at trial of this matter,” the lawsuit states.

Weddle was a friend of Elden’s father Rick, which is how young Spencer ended up on the album cover. “[Weddle] calls us up and was like, ‘Hey Rick, wanna make 200 bucks and throw your kid in the drink,’” Rick told NPR in 2008. “I was like, ‘What's up?’ And he’s like, ‘Well, I’m shooting kids all this week, why don’t you meet me at the Rose Bowl, throw your kid in the drink?’ And we just had a big party at the pool, and no one had any idea what was going on!” Spencer was reportedly sent a platinum copy of Nevermind and a teddy bear by Geffen Records in 1991.

Elden recreated the image multiple timesover the years and had the word “Nevermind” tattooed on his chest, but in a 2016 interview with GQ Australia, Elden revealed that he had recently become unhappy about the Nevermind artwork. “It’s fucked up,” he said. “I’m pissed off about it, to be honest.”

The naked swimming baby from the cover of the groundbreaking Nirvana album “Nevermind” re-enacted the image for the record’s 25th anniversary — this time wearing clothes.

Spencer Elden, 25, wanted to go au naturel when he made a splash to honor the legendary grunge band, he told The Post.
“I said to the photographer, ‘Let’s do it naked.’ But he thought that would be weird, so I wore my swim shorts,” said Elden, an artist from LA.

The album, released 25 years ago Saturday, includes songs like “Smells Like Teen Spirit” and “Come as You Are” and has sold more than 30 million copies worldwide.

“The anniversary means something to me. It’s strange that I did this for five minutes when I was 4 months old and it became this really iconic image,” he said.

“It’s cool but weird to be part of something so important that I don’t even remember,” said Elden, who prefers the punk band The Clash over Nirvana.

In 1991, photographer Kirk Weddle asked Elden’s parents if he could use the baby for a photoshoot for the then-unknown band, according to Time magazine. A fish hook with a dollar bill was later added digitally to the image.

The shoot lasted 15 seconds and Elden’s parents made only $200, his dad told NPR in 2008.

Earlier this month, photographer John Chapple paid him $200 to do it again, he told The Post.

Elden hopped in a lap pool at The Rose Bowl Aquatics Center in Pasadena to recreate the album cover image.

Elden did the same thing 10 years ago, in honor of the album’s 15th anniversary.

Not sure how any lawyer would have taken this case? It says they asked his parents, they are your legal guardians at that time. Open shut case closed.

You also recreated the photo a few times showing you embraced the fame and fun of it. Can’t change your mind now

This is why I’m curious how this is even a thing? If it was against their will that’s different. But it sounds like they asked, and were also paid….. so how can you sue now?

Idk makes zero sense to me. It’s like my son in 18 years suing because he wasn’t born at a hospital he thinks he should have been born at.

Yeah, I hope this dickhead doesn't get a dime. Like others said, he seemed fine with it and re-enacted the picture on several occasions. He must have made some bad life choices because now he's trying to get some money from it.

I did read somewhere about there not having been any paperwork/contract to use the picture. But it just seems like a dipshit thing to do at this point.

I have some alternate cover ideas myself:
- Flip the baby vertically to imply it drowned, thus obscuring its penis.
- Add people to the bottom of the pool pointing and laughing at the baby’s penis.
- Give the baby an inner tube with a miniature version of his head on the plug a la Wade the Duck from the old Garfield cartoon.
- Replace the baby with William Shatner.
