So I'm thinking of taking legal matters and want to know if anybody on this site knows of any good lawyers. I'll basically be fighting against my employer and/or the union.

I have the feeling I'm getting dicked around by my employer and the union that I'm in (Local 150-Operating Engineers) is good for nothing. I have no health benefits and honestly, I have no reason why I have to even be in the union if they don't do shit for me. Basically taking money from me without having to do anything. Not gonna happen.

So does anybody know any or know of any lawyers? (Please keep on topic)

Talk to your Steward, though i think you've probably done that already.

Can't talk to the steward since he got fired a long time ago and nobody has taken his place. :dunno:

I'm not sure exatly what kind of lawyer to talk to. But I know there's lawyers that specifically have experience with unions and what not. But I'd still need one to go against my work (possibly); I gotta find out if I have a case or not, and that is why I'm trying to talk to some lawyers now to find out if it's a pursuable case.

I have not talked to the union nor my employer due to the fact that if I do have a case, the more I talk to them about what could be a possible case, the more I can jeopardize it(the case). So I prefer to speak to a/some lawyer/s prior to anything else.

I know a little bit of what I could do. Find out union number (I never received it) and see if I'm in the union. I would also need a contract between me and union, and union and employer (to see what they consider commercial pay). If I'm not in union, the that's a red flag right there that my employer is taking money out of my checks for "union."

in my line of work, there is such a thing as "Fair Share" deductions that afford you certain rights guaranteed by the union, but not actually be in the union.

What I mean by this is that if they deduct fair share fees, you can be represented by the union in case of a situation with a possibility of discharge, but you cannot attend meetings, nor vote in union votes.

I never knew that. But knowing my employer, and the steward that used to work with me, I highly doubt that this would be the case. Plus I believe I would have to still sign some paperwork regardless since they are taking money out of my paychecks without my consent. I never agreed, verbally, or written, to anything. But we'll see where this takes me. I did email one law firm. Hopefully they'll get back to me.
