a CC as in credit card? Hes not allowed to automaticly charge you? You have a right to argue the ticket.

but does there law require you to pay since you're out of state then get a refund if the judge says so?

I had to pay on the spot or I think I would have gotten taken in, think it was bond. I decided to pay on the spot since I had 4 cases of beer in the car and im under age.
